Terms of Use
1. Scope
These Terms of Use govern the use of the Mini Caddie application (hereinafter referred to as the “App”) by its users. The operator and responsible party within the meaning of German law (§ 5 TMG) is:

2. Registration and Login
Use of the App requires registration and authentication via an email-based magic link login process. For this purpose, the email address provided by the user is processed in order to send a one-time, time-limited login link. The email address is used solely for authentication and account management purposes. It is not used for personalization, marketing, or any other purpose beyond operation of the App. Further information on the processing of personal data can be found in our Privacy Policy. By using the App, you agree to these Terms of Use and the Privacy Policy.
3. Service Description
Mini Caddie provides registered users with access to a web-based application that can be used after successful login. The App is provided free of charge. There is no entitlement to uninterrupted availability or specific features.
4. Usage Analysis and Further Development
To ensure the technical operation and further development of the App, we reserve the right to evaluate the use of individual functions in pseudonymized form. For this purpose, a randomly generated tracking ID is used, which is not derived from the user account and does not allow any direct conclusions to be drawn about the identity of the user. The evaluation is carried out exclusively for statistical purposes as well as for the technical and functional improvement of the App. No profiling, merging with personal clear data, or use for advertising purposes takes place. 5. User Obligations
Users agree to:
- use the App only for lawful purposes,
- not bypass or interfere with security mechanisms,
- not infringe upon the rights of third parties (e.g. intellectual property or privacy rights).
We reserve the right to suspend or delete user accounts in the event of violations.
6. Liability
We are liable only for damages caused by intent or gross negligence. In cases of slight negligence, we are liable only for breaches of essential contractual obligations (“cardinal duties”), limited to foreseeable and typical damages. Liability for damage to devices or other property arising in connection with use of the App is excluded unless caused by intentional or grossly negligent conduct. The App is intended for the acoustic detection and analysis of sounds generated by dropping a ball near the device’s microphone. The safe placement of the device and selection of a suitable environment are solely the responsibility of the user. Additional protective measures, such as cases or screen protectors, may reduce the risk of damage. These recommendations do not constitute a guarantee and do not establish additional liability. Use of the App is at your own risk.
7. Intellectual Property
All content, trademarks, logos, and other elements of the App are protected by copyright and other intellectual property laws. Any use, reproduction, or distribution outside the App requires prior consent of the operator.
8. Termination
You may terminate your use of the App at any time by deleting your user account. Your access will be deactivated and your stored personal data will be deleted in accordance with applicable legal requirements.
9. Changes to the Terms
We reserve the right to amend these Terms of Use where required for legal or technical reasons. Users will be informed of any material changes in advance. Continued use of the App after the changes take effect constitutes acceptance of the revised Terms.
10. Governing Law
These Terms are governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction, where legally permissible, is Kiel, Germany.
